The following terms and conditions apply to the website and services offered by Kuyu Colonics. By using the website and services, you agree to be bound by these terms and conditions and our privacy policy.    

In these terms and conditions, the words “website” refer to the Kuyu Colonics website, “we”, “us”, “our”, and “Kuyu Colonics”, refers to Kuyu Pty Ltd, and “client”, and “user”, refers to you, the user or client of Kuyu Colonics.      

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR OBTAINING ANY INFORMATION OR SERVICES FROM KUYU COLONICS.  

1. ACCEPTANCE OF TERMS  

This agreement sets forth the legally binding terms for your use of the website and services offered by Kuyu Colonics. By accessing and using the website and its services, you agree to abide by the provisions of this agreement. If you do not agree to these terms, you must refrain from using the website and services. We reserve the right to modify this agreement at any time, and such modifications shall be effective upon posting on the website. By continuing to use the website and services following the posting of any modifications, you agree to be bound by the updated terms; therefore, it is important that you review this agreement periodically.  Kuyu Colonics reserves the right, in its sole discretion, to refuse to provide services to any user or client and to modify its eligibility criteria at any time. This provision shall be inapplicable in those jurisdictions where it is prohibited by law and, in such cases, the right to access the website and services will be revoked.  By using the website and services, you represent and warrant that you have full power, authority and capacity to enter into this agreement and to perform all obligations hereunder. You further represent and warrant that you are not subject to any legal incapacity or contractual restriction that would prevent you from entering into this agreement.  

2. NOTIFICATIONS AND NEWSLETTER  

By providing Kuyu Colonics with your e-mail address, you agree that we may use your e-mail address to send you important notifications and communications about our services, news and special content. If you do not wish to receive these e-mails, you may opt-out of receiving them by sending us your request through our contact information or by using the “unsubscribe” option in the e-mails themselves. This option may prevent you from receiving emails about our services, important news and special content.    

3. BOOKING AND PAYMENT  

3.1. Prices and Fees  
Prices for colon hydrotherapy sessions, as well as pre-paid packages, are available on our official website and can be quoted at the time of booking. These prices are subject to change without prior notice, although any adjustment in rates will not affect confirmed bookings.  

3.2. Deposits and Appointment Guarantee
To guarantee an appointment, a deposit of 50% of the total cost of the service is required at the time of booking. This deposit confirms your space in our schedule and allows us to effectively plan our resources and schedules. The remaining balance of 50% is due prior to the start of the scheduled session. If the balance is not settled at the time of the appointment, Kuyu Colonics reserves the right to cancel the session, with no refund of the deposit paid in advance.  

3.3. Accepted Methods of Payment  
Kuyu Colonics accepts the following forms of payment:  
• Credit and debit cards (Visa and MasterCard only)  
• Cash in local currency  
• Gift cards issued by Kuyu Colonics  

Customers are advised that credit card surcharges or fees may apply. These additional charges will be detailed at the time of the transaction.  

3.4. Booking Confirmation  
Once the deposit has been paid, a booking confirmation will be sent to the client by email or text message. This confirmation will include details of the appointment, such as date, time and location, along with a summary of the terms applicable to the booking.  

3.5. Changes or Cancellations
Changes or cancellations to appointments are subject to our cancellation policy. In the event of cancellation outside of the permitted time frame or no-shows, the deposit paid will be non-refundable and will be considered as compensation for the time booked.  

3.6. Prepaid Package Payments
Prepaid packages offer an economical option for those planning multiple sessions. The total cost of the package must be paid in full at the time of purchase. If you choose to cancel the use of a package, the standard rates for the individual sessions used will apply, and any remaining balance may be refunded or held as a credit in accordance with our refund policy.  

3.7. Customer Responsibility
It is the client’s responsibility to ensure that the payment details provided are accurate and up to date. Any failure to process payment, whether due to insufficient funds or errors in the information provided, may result in the cancellation of the booking.  

3.8. Additional Terms for Gift Cards  
Gift cards may be used as a form of partial or full payment for services. Any balance remaining after using a gift card can be paid using accepted payment methods. Gift Cards are not refundable or redeemable for cash.  

3.9. Receipts and Invoices  
After each transaction, Kuyu Colonics will provide an itemized receipt or invoice reflecting the amount paid, any remaining balance, and the service booked. These documents can be requested in digital or printed format according to the client’s preference.    

4. SESSIONS  

Colon hydrotherapy sessions must be booked in advance and are subject to availability. By making a reservation, the client accepts the terms regarding punctuality, cancellations and payments established by the company. It is the client’s responsibility to show up on time for their scheduled appointment. If a client arrives 20 minutes or more late, the session will be considered a forfeit and there will be no right to a refund or rescheduling. This approach allows us to respect the time of other clients and ensure an efficient flow of our operations.

Each session is designed to provide the best possible experience within the allotted time. Clients who have booked pre-paid packages or services will be subject to the same conditions, and any sessions missed due to significant delay will be deducted from the package without the possibility of a refund. KUYU Colonics is not responsible for sessions missed due to client lateness.  

It is essential that clients follow the pre-treatment recommendations provided by the KUYU Colonics team to ensure the effectiveness and safety of the procedure. Failure to follow these recommendations may affect the treatment experience or results, without any liability on the part of KUYU Colonics.  

We recommend that clients arrive in plenty of time to make any necessary preparations prior to the session. If you anticipate that you will not be able to arrive on time, we ask that you contact us as far in advance as possible to evaluate alternative options within our policies and availability. Punctuality is key to ensuring an optimal experience for all our clients. By booking a session with KUYU Colonics, you accept and acknowledge these conditions in full.    

5. CONTRAINDICATIONS  

At Kuyu Colonics, your safety and well-being are our top priority. Before booking a treatment, it is important that you check if any of the following medical conditions apply to you. These conditions may contraindicate the use of colon hydrotherapy and could pose a risk to your health:  

• Crohn’s disease in inflammatory or haemorrhagic phases.
• Active or haemorrhagic ulcerative colitis.  
• Severe haemorrhoids or severe bleeding.  
• Rectal bleeding other than mild haemorrhoids.
• Diverticulitis.  
• Renal disease or renal failure.  
• Abdominal or inguinal hernia.  
• Gastrointestinal bleeding or perforation.
• Abdominal, pelvic or colon surgery within the last 12 months.
• Colostomy.  
• Intracranial hypertension.  
• Congestive heart failure, recent heart attack or cardiac surgery.
• Cirrhosis of the liver.
• Severe anaemia.
• Aneurysms.  
• Active chemotherapy treatment for any type of cancer.  
• Kidney dialysis.  
• Cancer of the colon, kidney or bladder.
• Tumours in the rectum or large bowel.  
• Anal fissures or fistulas.  
• Seizures or epilepsy.  
• Medications or conditions that may weaken the intestinal walls.
• If you have had abdominal or pelvic surgery in the last 3 months or if you are pregnant, contact us to evaluate your options.  

Important  
Our team is not trained to evaluate or diagnose medical conditions, allergies or medications. If you have any doubts about your medical condition, please consult your doctor before booking treatment.  

Kuyu Colonics does not treat anyone under the age of 18 or over the age of 90.

6. RISKS  

Clients acknowledge and accept that, although colon hydrotherapy is generally considered safe, like any procedure, it involves certain inherent risks.

The treatment may carry the risk of spreading viral, bacterial or fungal infections if strict protocols for cleaning and disinfection of equipment and surfaces are not followed. Also, if the procedure is not performed correctly, if there are underlying undiagnosed medical conditions, or if there are individual vulnerabilities, complications may arise.

Possible risks include injury to the colon, such as ulceration or perforation, as well as exacerbation of chronic bowel diseases such as diverticulitis, Crohn’s disease or haemorrhoids. Adverse effects such as thermal burns, dehydration, overhydration, alterations in intestinal flora and electrolyte imbalances may also occur.  

To minimise any associated risks, it is strongly recommended that clients consult with their physician or healthcare professional before undergoing treatment to confirm that colon hydrotherapy is appropriate and safe for their particular condition. Prevention and prior care are essential to ensure a positive and safe experience.

7. MEMBERSHIPS  

7.1. Types of Membership  
Kuyu Colonics offers two membership options:  

• Standard Membership: includes one standard colonic treatment per month, a 5% discount on in-store products and a welcome gift upon sign-up.  
• Premium Membership: includes two colonic treatments per month, a monthly therapeutic supplement, a 10% discount on in-store products and a welcome gift upon registration.  

7.2. Membership Duration  
Memberships have a fixed duration of 12 months and payments are made on a monthly basis by automatic debit to the payment method provided.  

7.3. Payments and Payment Obligations  
Membership fees are final and non-refundable. It is the member’s responsibility to ensure that payment details are up to date to avoid interruptions in benefits. In the event of non-payment, Kuyu Colonics will notify the member, allowing five working days to rectify the problem. If payment is not made within 14 days, membership may be suspended or cancelled, and interest may be charged on outstanding amounts in accordance with applicable laws.  

7.4. Reflection Period  
New members are entitled to a cooling-off period of seven days from activation of membership to cancel without penalty, provided that no benefits have been used. Cancellations must be made in writing by email.  

7.5. Membership Cancellation  
To cancel a membership, the member must give written notice at least 30 days prior to the next billing cycle. During this period, active benefits will be maintained and the appropriate charge will be applied. No refunds will be granted for unused treatments or early cancellations, except for documented exceptional circumstances, such as medical reasons.  

7.6. Suspension of Membership  
Members may request temporary suspension of their membership for a minimum of one month and a maximum of three months for personal or medical reasons. During this period, benefits will be frozen and payments will be paused. The request for suspension must be submitted in writing and is subject to approval.  

7.7. Conditions of Use of Benefits
Treatments included in the membership must be booked and used within the relevant month. Unused treatments will not be cumulative, except on the recommendation of the therapist for health reasons. Discounts and benefits associated with membership cannot be combined with other promotions or discounts.  

7.8. Modifications to the Terms  
Kuyu Colonics reserves the right to modify the terms, prices and benefits of memberships by giving members at least 30 days’ notice before the changes take effect.  

7.9. Minimum Age  
Memberships are available only to persons 18 years of age or older. Minors may register only with the consent of a legal guardian and under specific conditions set by Kuyu Colonics.    

8. GIFT CARDS  

8.1. Purpose and Use  
Kuyu Colonics gift cards are designed to give recipients access to our wellness services and colon hydrotherapy treatments. These cards are a flexible way to enjoy our services or share them with friends and family.  

8.2. Validity and Expiration Date  
Gift cards are valid for 12 months from the date of issue. Once expired, they cannot be used to purchase services or products at Kuyu Colonics. Customers are advised to use the available balance within the validity period to avoid inconvenience.  

8.3. Eligible Services  
Gift cards can only be redeemed for services and treatments offered by Kuyu Colonics at the time of redemption. They may not be used to purchase products, additional cards or services outside those officially listed in our catalogue.  

8.4. Non-Refundable and Non-Convertible  
The value of gift cards is non-refundable under any circumstances and cannot be redeemed for cash, credit balance or other benefits. All Gift Card purchases are final.  

8.5. Transfer of Ownership  
Gift Cards are fully transferable and can be used by anyone who physically owns them at the time of redemption, provided they are within their period of validity. Kuyu Colonics is not responsible for unauthorised transfers or misuse.  

8.6. Liability in the Event of Loss or Theft  
The purchaser or bearer is fully responsible for the protection of the card. Kuyu Colonics does not offer replacement or compensation for lost, stolen or damaged cards.  

8.7. Partial Use Charges  
If the value of the selected service is less than the available balance on the gift card, the remainder will remain available for future use within the validity period. No refunds will be issued for unused balances remaining before the expiry date.  

8.8. Accumulation of Cards
 Multiple gift cards may be used in a single transaction to cover the total cost of a service. If the combined value exceeds the amount of the service, the remaining balance will remain active on the most recently used card.  

8.9. Reservations and Cancellation Policies  
Gift cards must be presented at the time of booking the service. If you need to cancel an appointment booked with a gift card, you must do so at least 24 hours in advance. Late cancellations or missed scheduled appointments may result in a balance deduction equal to the cost of the service booked.  

8.10. Upgrades and Modifications  
Kuyu Colonics reserves the right to update policies related to gift cards. The current terms and conditions will be posted on our official website, and any subsequent use of the cards implies acceptance of the new terms.  

8.11. Activation and Fraudulent Use  
To protect the integrity of the cards, all purchases must be activated through official Kuyu Colonics channels. Any attempted fraudulent use, tampering or alteration will invalidate the card with no right to compensation.  

8.12. Acceptance of Terms and Buyer’s Liability  
By purchasing or using a Kuyu Colonics gift card, the purchaser and user agree to the terms and conditions described herein. We encourage all users to read these provisions carefully before purchasing or redeeming a card.    

9. LIMITATION OF LIABILITY  

Clients of Kuyu Colonics acknowledge that colon hydrotherapy is a complementary procedure and not a medical treatment. Kuyu Colonics does not act as a health care provider or monitor the general medical condition of its clients. The company does not have access to the medical history or clinical records of its clients beyond the information provided voluntarily through the intake form. Kuyu Colonics performs its services on the basis of the information disclosed on the intake form, with no responsibility to verify the accuracy, completeness or sufficiency of such information.  

Clients accept that any omissions, errors or misrepresentations in the information provided may increase the risk of complications or adverse outcomes. Kuyu Colonics will not be liable for adverse reactions, complications or side effects resulting from incomplete, inaccurate or undisclosed information on the part of the client, provided that the procedure has been carried out in accordance with professional industry standards and with due care.  

Kuyu Colonics and its practitioners do not guarantee specific results from colon hydrotherapy, as the effects and benefits may vary significantly between individuals depending on their physical condition and state of health. The company assumes no liability if the client does not achieve the desired results, and no guarantees, representations or warranties are made as to the effectiveness of the treatment. To the extent permitted by law, Kuyu Colonics disclaims any liability associated with failure to meet the client’s expectations.  

Customers also acknowledge that colon hydrotherapy may involve certain inherent risks, and that any adverse reactions or complications that arise, provided the procedure has been performed in accordance with standard industry practice and without negligence on the part of Kuyu Colonics, are the responsibility of the client. In the event of experiencing ongoing symptoms or side effects after the procedure, clients are strongly advised to consult their health care provider for guidance and appropriate treatment.  

Kuyu Colonics excludes all liability for any loss, damage or injury suffered by clients as a result of failure to follow instructions provided by the company’s professionals, whether verbal instructions or safety instructions printed on the premises. This includes but is not limited to misuse of the facilities, failure to communicate relevant medical conditions, or failure to comply with post-procedure recommendations. The liability of Kuyu Colonics shall be limited only to cases where direct negligence or failure to comply with standard practices by its professionals or staff is proven.  

Furthermore, Kuyu Colonics shall not be liable for indirect, incidental, consequential or punitive damages, including but not limited to lost income, additional medical costs, or any emotional damages arising from the client’s experience with the procedure.  

This limitation of liability is not intended to exclude rights that clients may have under applicable consumer protection laws, but clearly states that, to the extent permitted by law, Kuyu Colonics’ liability shall be strictly limited to the cost of the procedure performed.  

By participating in a colon hydrotherapy procedure at Kuyu Colonics, the client confirms having read, understood and accepted this limitation of liability clause, acknowledging the complementary nature of the treatment and the associated risks.    

10. COPYRIGHT  

All content on Kuyu Colonics website, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software and other items are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Kuyu Colonics or by third parties who have licensed or provided their material to the website. You acknowledge and agree that all materials on Kuyu Colonics are made available for limited, non-commercial, personal use only. Except as specifically provided herein. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Kuyu Colonics prior express written permission. You may not add, delete, distort, or otherwise modify the material. Any unauthorised attempt to modify any material, to defeat or circumvent any security features, or to utilise Kuyu Colonics or any part of the material for any purpose other than its intended purposes is strictly prohibited.    

11. COPYRIGHT INFRINGEMENT  

Kuyu Colonics will respond to all enquiries, complaints and claims relating to alleged infringement by breach or violation of the provisions contained in Australian and international copyright and intellectual property laws and regulations. Kuyu Colonics respects the intellectual property of others and expects users to do the same. If you believe, in good faith, that any material provided on the website infringes your copyright or other intellectual property rights, please submit your request via our contact information, with the following information:    

• Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers or a statement regarding ownership of the work should be included.

• Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.  
• Deep-link to any portion of the services for any purpose without our express written permission.  
• “Frame”, “mirror” or otherwise incorporate any part of the website into any other websites or service without our prior written authorisation.  
• Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Kuyu Colonics in connection with the services.  
• Circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content.    

14. DISCLAIMER OF WARRANTIES

Due to the nature of the Internet, Kuyu Colonics provides and maintains the website on an “as is”, “as available” basis and does not promise that use of the website will be uninterrupted or error free. You will be responsible for any breach of these terms by you and if you use the website in breach of these terms you will be liable to and will reimburse Kuyu Colonics for any loss or damage caused as a result.  

Kuyu Colonics shall not be liable in any amount for any failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control, including, without limitation, Internet outages, communications outages, fire, flood, war or any uncontrollable act of nature.  

These terms do not affect your statutory rights as a consumer which are available to you.  

Subject as aforesaid, to the maximum extent permitted by law, Kuyu Colonics excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Kuyu Colonics and Kuyu Colonics shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:  

• Any incorrect or inaccurate information on the website.  
• The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or service purchased through the website.  
• Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control.  
• Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

16. INDEMNIFICATION  

You agree to defend and indemnify Kuyu Colonics from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:  

• Your breach of this agreement or the documents referenced herein.  
• Your violation of any law or the rights of a third party.  
• Your use of the website and services.    

17. CHANGES AND TERMINATION  

We may modify the website and these terms at any time, at our sole discretion and without notice. You are responsible for keeping yourself informed of these terms. Your continued use of the website constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified, all changes to these terms apply to all users and clients. In addition, we may terminate our agreement with you under these terms at any time by notifying you in writing (including by email) or without notice.    

18. INTEGRATION CLAUSE  

This agreement together with the privacy policy and any other legal notices published by Kuyu Colonics, shall constitute the entire agreement between you and Kuyu Colonics concerning and governs your use of the website and the services.    

19. FORCE MAJEURE  

Kuyu Colonics shall not be liable for any failure or non-performance of services due to causes beyond its reasonable control, including but not limited to acts of civil authorities, acts of military authorities, riots, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances and which may prevent the performance of our services.    

20. ARBITRATION  

You acknowledge and agree that any dispute, claim or controversy arising out of or relating to these terms and conditions, whether for breach, termination, performance, interpretation or validity, as well as any aspect of your use of the website and our services, shall preferably be resolved by binding arbitration between you and Kuyu Colonics. Notwithstanding the foregoing, the right of both parties to bring individual claims in a court of competent jurisdiction if they deem it necessary remains.  

In the event of any dispute arising in connection with your use of the website and our services or breach of these terms and conditions, both parties agree to seek resolution through an arbitration process. This process will be conducted before a recognised and respected arbitration entity, selected by mutual agreement of both parties and following the applicable commercial arbitration rules.  

In addition, the user agrees, to the extent permitted by applicable law, not to initiate, join or participate in class action lawsuits associated with any claim, dispute or controversy that may arise in connection with the use of the website and our services. This commitment seeks to promote a more agile and personalised resolution of any conflict, favouring arbitration and individual legal actions over class actions.

These terms and conditions shall be governed by and construed in accordance with the laws of Australia. Any dispute relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Canberra, Australia.
